Alabama’s basic formula is appraised value × property assessment percentage = assessed value, then assessed value × applicable millage = unadjusted tax. Alabama’s 7% Cap: Why Market Value and Taxable Value Can Differ
Act 2024-344 limits annual increases in the taxable assessed value of qualifying Class II and Class III real property. It does not prevent the county from determining a higher market value.
When the cap can apply
- The parcel is eligible Class II or Class III real property.
- It was already assessed in the prior year.
- Its true assessed value increased by more than 7% compared with the prior taxable assessed value.
- The parcel does not meet an exclusion from the cap.

Important exceptions to the ownership-change rule
Alabama identifies exceptions for certain transfers between spouses or family members for no or nominal consideration or because of the original owner’s death, and for redemption following foreclosure, tax sale or tax lien. Other cap exclusions can still apply.
What is the “cap gap”?
If market values rise quickly, the capped taxable assessed value can remain below the property’s true assessed value. In a later market downturn, taxable assessed value may still rise by the permitted amount until it catches up with the lower true assessed value. A lower market appraisal therefore does not always produce an immediate tax reduction when a cap gap remains.
The current statutory limitation is scheduled to continue through the fiscal year beginning October 1, 2027.

How the three-year rollback can matter
Alabama states that when the rollback provisions apply, additional taxes are generally calculated for the three years preceding the tax year beginning on the October 1 following conversion. If the parcel had current-use treatment for less than three years, the rollback covers only the actual qualifying period.

What does Clarke County’s tax-lien notice mean?
The Revenue Commissioner still links a legal notice declaring that Clarke County chose the sale of tax liens as its delinquent-tax collection method beginning with tax year 2022. The notice states that the method remains in effect for future collection years unless a later proclamation changes it.
Change a Clarke County Property-Tax Mailing Address
The official address-change PDF says the request must be made in writing. The Revenue Commissioner cannot accept an address change over the phone.
